The Data Protection Policy of Fundació Mútua General de Catalunya, Fundación Privada (hereinafter, FUNDACIÓ MGC) provides, in relation to the personal data of the people with whom it maintains a link, the treatment it carries out, the legitimacy of its obtaining, its conservation, the possibility of communicating it and the rights that the interested parties have, in accordance with the current regulations on the matter.

For what purpose do we process your personal data?
The main purpose for which we process your personal data, including health data, lies in fulfilling the obligations arising, among others, from the provision of the medical services concerned, the development of preventive medicine programs and the sponsorship of charitable and cultural activities.
We also process your data for ancillary purposes, to inform you of products and services that may be of interest to you, special offers or promotions, and for the delivery of gifts and participation in raffles, related to the activity of FUNDACIÓ MGC or the entities in which it participates or is linked to, including the creation of profiles to offer products and services according to your interests. This information may be provided through any usual communication channel, including electronic and telephone, through which we will also send you magazines and newsletters about the entity’s own activities.
On the other hand, we will process your data when studies are to be carried out, even after the contractual relationship has ended, for the purposes of statistical collaboration or technical and commercial prospecting, surveys and quality control, as well as to prevent fraud.
The FUNDACIÓ MGC facilities have a video surveillance system through which real-time images of users are recorded, with the exclusive purpose of security and access control to the facilities.
Ultimately, if necessary, recorded telephone conversations, derived from the request, management and provision of the medical service concerned or from participation in preventive medicine programs or sponsorship of charitable and cultural actions, will be used for quality control or as evidence in claims and/or judicial or arbitration proceedings, preserving their confidentiality.
How long will we keep your data?
Your data will be kept as long as the provision of the medical service in question, participation in preventive medicine programs or sponsorship of charitable and cultural activities continues, and in response to possible responsibilities arising from these relationships, in accordance with the legally established limitation periods.
Likewise, we will keep them until they are necessary for the purposes of the treatment for which you granted consent.
In any case, your data will be kept for the legal retention periods, especially, in the case of healthcare services provided, with regard to the corresponding clinical documentation.
What is the legitimacy for the processing of your data?
The legal basis for the processing of your data is the provision of the medical service concerned, the development of preventive medicine programs and the sponsorship of charitable and cultural activities, for which the interested party has expressed their consent, as well as the fulfillment of the corresponding legal obligations. In the case of minors, the consent will be understood to be granted by the holder of their parental authority or legal guardianship.
Likewise, in the case of ancillary purposes, the legitimacy to process your data is constituted by the consent granted, in accordance with the purposes described.
Ultimately, and in summary, the legitimacy for the processing of your data lies in the legitimate interest of FUNDACIÓ MGC to carry out the medical service, offer you new products and services adapted to your interests or carry out statistical studies and calculations, technical and commercial prospecting, and quality control.
The benefits, programs and sponsorships concerned cannot be made effective in the event of opposition to the processing of the data.
To which recipients will your data be communicated?
FUNDACIÓ MGC will communicate your data, in the exercise of its own functions, to entities in which it participates or is linked, to other people, entities and institutions that collaborate with FUNDACIÓ MGC for the provision of services, and, where appropriate, with financial entities for the financing concerned.
Likewise, your data, including health data, may be communicated to doctors and health professionals, hospitals and health centers, to provide the assistance requested, as well as to request or verify from these health service providers the causes and medical history related to the aforementioned assistance, and, finally, to the insurance entities with which the patient has signed an insurance contract, for the purposes of payment of the guaranteed benefits.
FUNDACIÓ MGC will not, under any circumstances, carry out international transfers of your data, nor will it communicate them to third parties, except under legal obligation or with your prior consent.
What commitment do we make regarding the processing of your data?
FUNDACIÓ MGC adopts the necessary measures in the processing of your data to avoid its alteration, loss or unauthorized treatment or access, which will be treated respecting current legislation and observing all security measures that guarantee its confidentiality.
The data we process will be adequate, relevant and not excessive for the purposes described.
What are your rights when you provide us with your data?
The rights that you have, in accordance with applicable regulations, are, on the one hand, the right to confirm whether FUNDACIÓ MGC has your data, to access it and request its rectification if it is incorrect or, where appropriate, to request that it be deleted if you consider that it is no longer necessary for the purposes for which it was collected.
Likewise, you have the right to request the limitation of the processing of your data, in certain circumstances, the possibility of opposing said processing, or the portability of the data provided to the entity.
Finally, you have the right to withdraw consent for a processing purpose other than the provision of the medical service, the development of preventive medicine programs and sponsorships, without this conditioning the provision, program or sponsorship.
